Your insurer can recommend a glass shop. It cannot require one.

If an adjuster tells you your windshield has to be done by a particular shop, that is not how California works. California Insurance Code 758.5 says, in its own words, "No insurer shall require that an automobile be repaired at a specific automotive repair dealer." You choose. The insurer can recommend a shop if you ask for a referral, or after it has told you in writing that the choice is yours. Once you have picked, the statute says it may not suggest you switch. That is the whole rule, and it applies to a rock chip picked up on SR-99 the same as it does to body work.

The one sentence that settles the argument

Most disputes over glass work end at that first sentence of Insurance Code 758.5. The statute does not say an insurer must pretend it has no opinion, and it does not say network shops are bad. It says the insurer cannot make the network a condition of getting your car fixed.

Two situations let an insurer name a shop, according to the statute text. The first is when you expressly ask for a referral. If you say "who do you recommend near Shaw and First," you have opened that door yourself. The second is when the insurer has informed you in writing of your right to choose a repair dealer before it recommends one.

That distinction matters on the phone. There is a difference between "here is who we recommend" and "we can only cover work done at this location." The second version is the one to push back on.

The written notice is the part to look for

The statute is specific about the form of that notice. It has to be in at least 10-point type, and it has to be in a separate document, not buried inside the declarations page or the claim packet's fine print.

So if you get a standalone sheet or a separate email telling you plainly that you have the right to select the automotive repair dealer of your choice, that is the insurer following the rule. That is a good sign, not a warning sign. What should get your attention is a referral that arrives with no such notice and no request from you.

Keep that document. If the claim gets messy later, a separate written notice is the cleanest evidence of what you were told and when.

Once you have chosen, the insurer is not supposed to relitigate it

The part of 758.5 that Fresno drivers hear about least is the last piece. Once the claimant has chosen a repair dealer, the statute says the insurer may not suggest a different one.

In practice that means the conversation about where the work happens should happen once. If you have told the claim rep that a specific shop is handling your windshield and scheduling a mobile visit to your driveway in Sunnyside or a school lot on Annadale Avenue in Sanger, repeated nudges toward somewhere else are not consistent with what the code says. You are allowed to say the choice is made and move on to the parts of the claim that actually need discussion, like glass type and recalibration.

Nothing here requires you to be adversarial. Most claim reps handle glass all day and will simply note the shop and process the claim.

What 758.5 does not do

Shop choice is not the same as free glass. California has no free-windshield law. Glass damage is generally a comprehensive claim subject to your deductible, unless your policy carries an optional full-glass rider, and a driver with liability-only coverage pays out of pocket no matter which shop does the work.

The statute also does not require an insurer to pay any amount a shop chooses to charge. It governs who does the work, not what the invoice looks like. Price questions go to your shop and your policy, and coverage questions go to your agent.

One more thing worth separating out. Comprehensive claims typically weigh less on rates than at-fault collisions, but "typically" is doing real work in that sentence, and your agent is the only person who can speak to your policy.

Why the choice is worth exercising on valley glass

The reason to care about 758.5 is not abstract. Around Fresno County, whose shop does the work changes the job.

Start with chips. Orchard roads out toward Reedley off Manning Avenue chip glass fast, Whitesbridge Avenue west to Kerman is hard on it, and packing-house truck traffic around Selma on SR-99 throws gravel year round. A chip caught early can often be repaired rather than replaced, and repair costs far less than replacement, frequently less than a comprehensive deductible. A shop that will look at a chip honestly instead of defaulting to a full replacement is worth choosing on purpose.

Then there is calibration. Many newer vehicles carry a forward-facing camera mounted to the windshield, and replacing the glass means that camera needs recalibration afterward. Ask any shop you consider how it handles recalibration and whether it is done in house. That answer is the difference between lane-keeping and emergency braking working the way the manufacturer intended and a warning light you learn to ignore on the SR-168 commute out of Clovis.

Geography matters too. This metro runs from Madera up in Madera County down to Reedley in the southeast, and construction downtown around the high-speed rail corridor and the Cesar Chavez Boulevard underpass has shuffled familiar routes. Mobile service is priced the same as in-shop work or close to it at many shops, so the shop that can reach your driveway may save you a trip across town during afternoon traffic on Blackstone or Herndon.

Questions Fresno County drivers ask

The adjuster gave me one shop and said that is the process. Now what? Ask whether you received the written notice of your right to choose a repair dealer, and say which shop you want. The code bars an insurer from requiring a specific automotive repair dealer.

Does 758.5 apply to a windshield, or only to body shops? The statute uses the term "automotive repair dealer" and does not carve glass out. Phrase it in the statute's own terms when you talk to your insurer.

Can I still use the shop my insurer recommended? Yes. Network shops do good work. The point is that going there is your call, not a condition of coverage.

Should I schedule a mobile replacement on a dense-fog morning? Later in the morning is the honest answer during fog season on 99. Glass work needs the adhesive to cure and the tech needs to get there safely.
